Terms of Purchase and Refund Policy
Effective date: July 13, 2026
These Terms of Purchase and Refund Policy govern purchases of online basketball and strength-training courses from:
- Legal business name: Matthys Van Bylandt, operating as Axis Development
- Operating/brand name: Axis Development
- Business address: Vancouver, BC, Canada (address on file)

In these Terms, “we,” “us” and “our” refer to the business identified above. “Purchaser” means the person completing the purchase. “Participant” means the person using the course.
By purchasing a course, the Purchaser confirms that they have reviewed and agreed to these Terms.
1. Course description
The course provides prerecorded and self-guided basketball and resistance-training education, which may include:
- Basketball drills and instructional videos
- Weight-training workouts
- Exercise demonstrations
- Training schedules
- Written guides and downloadable materials
- General information about athletic development
The exact content included in the purchase is described on the applicable course sales page.
The course does not include:
- Live or in-person supervision
- Individualized personal training
- Medical advice or diagnosis
- Physiotherapy
- Injury rehabilitation
- Emergency assistance
- Guaranteed athletic or physical results
2. Course information
- Course names: Axis Development Standard ($400 CAD/yr) and Premium ($800 CAD/yr)
- Purchase price: as displayed at checkout, plus applicable taxes
- Access begins: Immediately after successful payment
- Delivery method: Electronic access through http://localhost:3002
- Access period: 12 months, renewing annually until cancelled
- Required equipment: a basketball, a full or partial court, and access to weight-training equipment appropriate to the athlete's program (see the Lift section of your portal for specifics)
- Technical requirements: A compatible internet-connected device, supported web browser and valid email address
The Purchaser is responsible for reviewing the course description, access period, equipment requirements and technical requirements before purchasing.
3. Eligibility and age requirements
The Purchaser and account holder must be at least 19 years old.
A Participant under 19 may use the course only when their parent or legal guardian:
- Completes the purchase;
- Acts as the account holder;
- Provides accurate guardian and Participant information;
- Accepts these Terms and the Assumption of Risk and Health Disclaimer; and
- Authorizes the minor to participate.
We may request reasonable confirmation of age or guardian authority. We may suspend or cancel access where information provided during checkout appears false or misleading.
4. Payment and automatic renewal
All prices are displayed in Canadian dollars unless stated otherwise.
This is a recurring annual subscription. The Purchaser authorizes us and our payment processor to charge the displayed subscription price, taxes and disclosed fees to the selected payment method immediately, and then automatically once every 12 months on the renewal date, until the subscription is cancelled.
The Purchaser may cancel automatic renewal at any time from the account billing settings in the portal, or by contacting support@axisdevelopment.ca. Cancelling stops future renewal charges; it does not refund the current paid period except as described in Section 6. We will make reasonable efforts to send a reminder before each renewal charge to the email on file.
If the price for a renewal term changes, we will disclose the new price before it is charged. The Purchaser is responsible for providing accurate billing and contact information and keeping the payment method on file valid.
5. Electronic delivery
Course access will normally be activated immediately after successful payment.
Login or access instructions will be sent to the email address provided during checkout. The Purchaser is responsible for entering a valid email address and checking spam or junk folders.
A purchase confirmation containing the transaction information and links to the agreements accepted at checkout will be emailed after purchase, and a copy of the agreements you accepted is always available from your account at /portal/agreements.
The Purchaser must contact support@axisdevelopment.ca if access is not received or does not work.
6. Refund and cancellation policy
Because this is digital content supplied shortly after purchase, all purchases are final and non-refundable once course access has been delivered, except:
- Where a refund or cancellation is required by applicable law;
- Where the same order was charged more than once;
- Where we permanently fail to provide the purchased access; or
- Where we approve a refund in our discretion.
A customer requesting assistance must contact support@axisdevelopment.ca and provide their name, purchase email and order number.
Nothing in this policy removes any cancellation, refund or other consumer right that cannot legally be excluded.
Approved refunds will be returned to the original payment method when reasonably possible.
7. Personal-use licence
The purchase gives the authorized Participant a limited, personal, non-exclusive, non-transferable and revocable right to access the course during the stated access period.
The course and all related videos, text, graphics, workouts, plans, downloads, branding and other materials remain our property or the property of our licensors.
The Purchaser and Participant must not:
- Share an account with another person;
- Allow multiple Participants to use one purchase;
- Copy, reproduce or republish course materials;
- Record or screen-record course videos;
- Upload materials to social media, websites or file-sharing platforms;
- Sell, sublicense or distribute course access;
- Remove copyright or ownership notices;
- Use the materials to create or operate another paid training program; or
- Attempt to bypass course security or access restrictions.
8. Account security
The Purchaser is responsible for protecting their password and account information.
The Purchaser must notify us promptly if they believe their account has been accessed without permission.
We are not responsible for losses caused by the Purchaser voluntarily sharing login information or failing to reasonably protect their account.
9. Suspension or termination
We may suspend or terminate course access for:
- Account sharing;
- Fraudulent payment activity;
- Unauthorized copying or distribution;
- Harassment or abuse directed toward our staff or other users;
- Attempts to damage or interfere with the website or course platform; or
- A material violation of these Terms.
Where reasonably possible, we will notify the Purchaser and provide an opportunity to correct the violation.
Termination for a material violation does not automatically create a right to a refund, subject to rights that cannot legally be excluded.
10. Physical activity and health
Participation in basketball and resistance training involves physical risks.
The Purchaser and Participant must review and accept the separate Assumption of Risk and Health Disclaimer before accessing the course.
The Participant is responsible for deciding whether they are physically able to participate, choosing appropriate exercises and weights, using suitable equipment and maintaining a safe training environment.
11. No guarantees
Individual results vary based on factors including age, experience, health, effort, consistency, recovery, nutrition, equipment and existing physical ability.
We do not guarantee:
- Increased strength;
- Increased vertical jump;
- Increased speed;
- Weight loss or muscle gain;
- Selection for a team;
- Increased playing time;
- Scholarships;
- Professional opportunities;
- Prevention of injuries; or
- Any other specific result.
Testimonials and examples describe individual experiences and do not promise that another Participant will receive the same results.
12. Third-party facilities and services
Participants may choose to use gyms, basketball courts, equipment, websites, payment processors or course platforms operated by third parties.
We do not own or control those third-party facilities or services unless expressly stated.
Participants must follow all facility rules, equipment instructions, age restrictions and supervision requirements.
We are not responsible for the independent acts, omissions, equipment, premises, policies or availability of a third-party facility or service provider, except where responsibility cannot legally be excluded.
13. Website and course availability
We may temporarily interrupt access for maintenance, security, technical problems or circumstances outside our reasonable control.
We may update exercises, videos or materials to improve quality, safety or accuracy.
We will not materially reduce the core course access already purchased without providing a reasonable alternative, extension or other appropriate remedy.
14. Limitation of liability
To the fullest extent permitted by law, we will not be responsible for indirect, incidental, special or consequential losses arising from the purchase or use of the course.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded, including liability arising from intentional misconduct or any other liability that applicable law prohibits us from excluding.
The separate Assumption of Risk and Health Disclaimer contains additional terms concerning physical activity and injury risks.
15. Privacy
We collect, use and disclose personal information according to our Privacy Policy.
Payment-card information is processed directly by our third-party payment processor. We do not receive or store complete payment-card numbers.
16. Electronic acceptance
Checking the required checkout boxes and selecting the final payment button constitutes electronic acceptance of these Terms and the other agreements identified at checkout.
The Purchaser confirms that they had an opportunity to:
- Review the order;
- Correct errors;
- Read and save the agreements;
- Accept or decline the agreements; and
- Contact us with questions before purchasing.
17. Changes to these Terms
The version of these Terms accepted at checkout governs that purchase.
We may update these Terms for future purchases and renewals. Material changes will not retroactively reduce previously purchased rights except where reasonably necessary for legal compliance, security or safety.
18. Governing law
These Terms are governed by the laws of British Columbia and the applicable laws of Canada.
Mandatory consumer-protection rights that apply in the Purchaser's province, territory or country remain unaffected.
19. Severability
If part of these Terms is found invalid or unenforceable, the remaining sections will continue to apply to the fullest extent permitted by law.
